Terms and Conditions
1. Scope
1.1 These General Terms and Conditions (T&C) apply to all users of the online platform Passion Driver (accessible at passion-driver.com and associated domains).
1.2 Passion Driver GmbH (hereinafter "we," "us," or "Platform") operates its website as a marketplace to facilitate contact between buyers and sellers of vehicles.
1.3 Deviating terms of users are not recognized.
2. Services of the Platform
2.1 We provide an online platform where sellers can list vehicles and buyers can view them and submit binding purchase offers.
2.2 We facilitate contact between buyer and seller once a purchase offer at the asking price has been received and the buyer has paid the brokerage fee.
2.3 We are not a party to the purchase agreement. The purchase agreement is concluded exclusively between buyer and seller.
3. Vehicle Brokerage Process
3.1 Vehicle information is published on www.passion-driver.com.
3.2 The buyer submits a binding purchase offer.
3.3 The seller accepts the purchase offer.
3.4 The buyer pays the brokerage fee.
3.5 The seller has the manufacturer's used car inspection carried out.
3.6 The broker shares the contact details between buyer and seller.
3.7 Upon request and by separate arrangement, the broker may offer additional services such as professional vehicle photography or an escrow account for payment processing.
4. Registration and User Account
4.1 To use certain features, the user must create an account.
4.2 The user undertakes to provide truthful, current, and complete information.
4.3 The user is obligated to keep their login credentials confidential and to notify us immediately if misuse is suspected.
5. Seller Obligations
5.1 The seller shall provide truthful, complete, and non-misleading information about the vehicle.
5.2 The seller guarantees that they are the lawful owner of the vehicle and that the vehicle is free from third-party liens.
5.3 By listing the vehicle, the seller grants the Platform the right to use and publish the provided content (photos, description). 5.4 The seller undertakes to submit the vehicle to a manufacturer's used car inspection (Section 7) upon acceptance of a purchase offer.
6. Buyer Obligations / Brokerage Fee
6.1 A purchase offer submitted through the Platform is binding.
6.2 If the offer is accepted by the seller, the buyer is obligated to pay a brokerage fee of 5% of the offer price to Passion Driver AG. The brokerage fee is already included in the bid.
6.3 Payment of the brokerage fee is a prerequisite for the exchange of the seller's contact details.
7. Manufacturer's Used Car Inspection and Right of Withdrawal
7.1 Upon acceptance of a purchase offer, the seller is obligated to have the vehicle inspected at their own cost at an official manufacturer-authorized workshop.
7.2 If the inspection reveals significant undisclosed defects (e.g., unreported accident damage, manipulations), the buyer may withdraw from the purchase.
7.3 In such a case, the brokerage fee paid by the buyer will be fully refunded by the Platform.
8. Limitation of Liability
8.1 We do not guarantee the accuracy, completeness, or timeliness of content provided by sellers.
8.2 We are not liable for vehicle defects, the fulfillment of the purchase agreement, or the conduct of users.
8.3 Our liability is limited to intentional misconduct and gross negligence. Liability for slight negligence is excluded to the extent permitted by law.
8.4 We are not responsible for the execution of the manufacturer's inspection or the interpretation of its results.
9. Data Protection
9.1 The collection and processing of users' personal data is carried out in accordance with Swiss data protection legislation (nDSG).
9.2 Further information can be found in our separate Privacy Policy.
10. Duration and Termination
10.1 Use of the Platform may be for an indefinite period.
10.2 We are entitled to temporarily suspend or permanently delete user accounts in the event of a violation of these T&C or legal regulations.
11. Final Provisions
11.1 Swiss law shall apply exclusively.
11.2 The place of jurisdiction for all disputes arising from or in connection with these T&C shall be the registered office of Passion Driver AG.
11.3 Should individual provisions of these T&C prove to be invalid, the validity of the remaining provisions shall remain unaffected.
